If you Purchase any Products and or Services from us you are acknowledging and agreeing to our Refund Policy.

Definitions:

Service Provider: River Tree Marketing Group LLC, a Pennsylvania limited liability company with its principal place of business in Lake Ariel PA 18436

Client: Anyone who completes a purchase of any products or services.

Product(s):When referring to our “product(s)” the product(s) being referenced are outlined in the following list with descriptions to give you a clear understanding.

- Digital Business Cards: This Product is a physical card that is NFC capable. The card is sized to fit in the average wallet or purse, and the printed design of the card can be customized. Full Artistic license is given to the Service Provider in creating and printing the Digital Business Card design. The Service Provider does take input from the Client to make the design into consideration but is not required to follow any exact specifications. The Digital Business Card will be linked to the URL address indicated in the purchase form.

- Digital Profiles: This Product is an online hosted page with personal information, provided by the buyer. The intention of this profile is to make information (provided by the buyer) easily accessible for anyone who accesses the page. All information provided to the Service Provider by the Client in the purchase form under the “Digital Profile Details” section description is automatically authorized for use on the Digital Profile page built by the Service Provider. Also all information provided to the Service Provider by the Client is not fact checked but rather assumed to be true. The Service Provider assumes no legal responsibility for any Links, Information, Images or other content used on the Digital Profile. If any details provided by the Client cause legal ramifications of any kind, full responsibility will be assumed by the Client.

- Digital Bundles: This Product is a bundle package of two of our Products. When Purchased the Client is entitled to a Digital Business Card, a Digital Profile. All Terms and Conditions of those two individual Products apply to the Digital Bundle.

Service(s):

- Digital Profile Maintenance Plan:

This Service is a subscription based plan that allows the Client up to 3 revisions to their Digital Profile per month. Revisions can include a change in text, functionality, color, image or video of any element on the Digital Profile. Elements are things that make up the design of the Digital Profile. Examples of Elements would be Clickable Buttons, Images, Image Frames, Borders, Videos, Backgrounds, Text fields, etc.

User: Any individual, organization, or entity that accesses, visits, or interacts with this website, including but not limited to those who browse, use, or contribute to the content, services, or features provided by this website. Users may include visitors, registered members, customers, or any other person engaging with the website in any capacity.

Payments: This refers to the exchange in which a Client would provide currency for our Products and or Services. We currently accept exclusively online payments through our secure PayPal-powered payment portal. Our portal is integrated with a Google Form using the Payable plugin for a seamless payment experience. It's important to note that payments made through this system are subject to the terms and conditions of the third-party service providers we use. As such, the Service Provider cannot be held responsible for any issues that may arise due to these third-party payment methods. These issues may include, but are not limited to, billing inaccuracies, payment processing, refund discrepancies, and more.

User Data: This is any information which is part of the order placement process for our Products and Services, we gather specific personal information from our Clients through our designated Google Form. By voluntarily providing this information, the Client explicitly authorizes the Service Provider to utilize this data for the purpose of crafting the purchased Product or Service. It is essential to note that any information which a Client does not wish to be shared should not be disclosed to the Service Provider. The only information that will remain private is information contained within the Sections of the order form labeled “My Digital Business” and “Shipping Address”.

Privacy Policy: A Privacy Policy is like a set of rules that our website or service follows to protect your personal information and privacy. It's a way for us to tell you what data we collect, why we collect it, and how we keep it safe. We outline how we conduct ourselves with your information as well as provide guidelines for you to follow.

It can occur for various reasons, such as the fulfillment of the agreed-upon terms, a breach of contract, mutual agreement, or other specified conditions outlined in the contract or agreement.

Product(s) and Service(s) Pricing:

- Digital Business Card: $30.00 USD Per Digital Business Card

- Digital Profile: $95.00 USD Per Digital Profile

- Digital Bundle: $105.00 USD Per Digital Bundle

- Digital Profile Maintenance Plan: $5.00 USD Per Month

Third Party Policies:

For services and products created utilizing Canva, the Service Provider is bound by Canva's terms and policies. The Service Provider disclaims liability for any changes or losses resulting from modifications to the aforementioned terms and policies. This encompasses, but is not confined to, potential losses such as webpages, products, applications, and other related elements. Users are encouraged to familiarize themselves with Canva's terms and policies to stay informed about any developments that may impact their services or products.

Orders and Payments:

- Placing Orders: Orders for products and services offered by the Service Provider can be placed through our official website RTllinx.com. By placing an order, the client agrees to the Terms and Conditions, Privacy Policy and Refund Policy outlined and linked herein.

- Payment Methods: Payments for orders are processed through the PayPal Portal linked with Google Forms. The client is responsible for providing accurate and up-to-date payment information. The portal is capable of accepting payment from various Credit Cards, Debit Cards, and Paypal accounts.

- Payment Terms: Payment terms, including the total amount due, payment schedule, and any applicable fees, will be specified in the invoice. Failure to make payments within the agreed-upon timeframe may result in Termination of the transaction.

- Payment Security: We process all payments securely via a Google form powered by Payable, which enables PayPal transactions. It's important to note that the security of your payment information is in your hands, as it's managed by PayPal. By proceeding with your payment, you acknowledge and accept full responsibility for the security and transaction process managed by PayPal.

- Currency: All transactions are conducted in the currency specified in the Payment Portal.

- Order Confirmation: Upon successful payment, the client will receive an order confirmation via the email address provided during the ordering process.

- Cancellation of Orders: The Service Provider retains the right to cancel an order under circumstances that include payment complications, unavailability of products or services, or other reasonable justifications.

- Refunds: Refund policies are outlined in a separate Refund Policy page. Clients are encouraged to review it for detailed information.

- Disputes: Any payment-related disputes should be promptly communicated to the Service Provider for resolution. The Service Provider retains the final authority in resolving such disputes.

- Modification of Orders: Requests for order modifications must be submitted in writing and are subject to approval by the Service Provider. In some cases, modification requests made too late may result in rejection.

- Taxes: The client is responsible for any applicable sales tax associated with the purchase, and these will be clearly communicated in the order summary on the payment portal.

Delivery and Fulfillment: The delivery and fulfillment process for our Products and Services entail a commitment to timely and secure delivery or access. Upon successful completion of the ordering process and receipt of payment, digital products, such as the "Digital Profile," will be accessible through a URL address Provided from the Service Provider to the Client. This URL address will be delivered via Email unless otherwise requested by the Client. For physical products, the Service Provider will utilize reputable shipping carriers to deliver Product(s) to the address provided during the ordering process. Delivery times may vary based on product availability and shipping destination. Clients will receive confirmation and tracking details for shipped products.

General Terms:

License to Use: Clients are granted a non-exclusive, non-transferable license to use the "Digital Business Card" and the "Digital Profile" for personal or business purposes. This license is subject to compliance with the terms and conditions provided by the Service Provider. Clients are prohibited from reproducing, distributing, or modifying the digital products beyond the scope of the license without explicit written consent from the Service Provider. The license is effective upon successful payment for the products and remains valid unless terminated in accordance with the termination clause outlined in the terms and conditions.

Intellectual Property: Ownership of intellectual property related to our products and website is retained by River Tree Marketing Group LLC. This includes, but is not limited to, trademarks, logos, digital content, and proprietary technologies. Clients are granted a limited license to use digital products for their intended purposes, as specified in the license to use section. Any unauthorized use, reproduction, or distribution of intellectual property is strictly prohibited. The Service Provider respects the intellectual property rights of others, and any concerns regarding potential infringement should be promptly communicated to the Service Provider for resolution. The terms and conditions establish clarity on the ownership and usage of intellectual property, fostering a transparent and mutually beneficial relationship between the Service Provider and Clients.

User-Generated Content: User-generated content refers to any content, including text, images, and other materials, created by users on their Digital Profiles or Digital Business Cards within our platform. We encourage users to express themselves creatively and responsibly while using our services. By generating content, users acknowledge and agree that they are solely responsible for the accuracy, legality, and appropriateness of the materials they upload or display.

The Service Provider does not claim ownership of user-generated content; however, users grant the Service Provider a non-exclusive, royalty-free license to use, reproduce, and display the content for the purpose of providing and promoting our services. Users retain the rights to their content and can remove it from our platform at any time. The Service Provider reserves the right to moderate and remove any user-generated content that violates our terms and conditions, infringes on intellectual property rights, or is deemed inappropriate.

Users are advised to respect the rights of others when creating content and to refrain from posting material that is defamatory, discriminatory, or violates any applicable laws or regulations. The Service Provider is committed to maintaining a positive and inclusive environment and will take appropriate action, including the removal of content and potential termination of services, in cases of non-compliance with these guidelines. - Breach of Agreement: Violation of any terms and conditions outlined in the agreement between the client and service provider.

- Misuse of Intellectual Property: Unauthorized use, reproduction, or distribution of the intellectual property developed or provided by the service provider.

- Unethical Conduct: Engaging in any unethical, fraudulent, or illegal conduct in connection with the products or services provided.

- Failure to Provide Necessary Information: Failure to provide necessary information, materials, or cooperation essential for the delivery of services or products.

- Material Changes in Scope: Substantial changes in the scope of the project or services without prior agreement from the service provider.

- Force Majeure: Events or circumstances beyond the control of either party that make it impossible or impractical to fulfill the terms of the agreement.

- Violation of Policies: Violation of any policies or guidelines provided by River Tree Marketing Group LLC related to the use of products or services.

Termination of services or products is not limited to the circumstances provided above. The Service Provider reserves the right to terminate services or products for any other reasons deemed appropriate. Upon termination.

Governing Law: These terms and conditions are governed by and construed in accordance with the laws of the state of Pennsylvania. Users agree to submit to the exclusive jurisdiction of the courts in Pennsylvania for the resolution of any disputes.
